New York Life May Deny Disability Insurance Claims
You may have been provided a New York Life long-term disability insurance policy through your job, or you may have purchased one on your own to protect your family. Regardless of how you obtained your New York Life long-term disability insurance policy, the company may be stringent and deny claim. If your claim has been denied, you have the legal means to fight back.
New York Life may deny your claim for a variety of reasons. They may simply claim that you do not meet the requirements for proving that you have a disability. Alternatively, the insurance company may believe that you are still able to work. Regardless of the reason for the denial, you may challenge the insurance company in court or through an appeal.
Your Routes to Taking Legal Action Against New York Life
When you have filed a long-term disability insurance claim, the insurance company reviews it to determine whether you fall into the plan’s definition of disabled. No matter how bad you think your condition is, the insurance company may reach another conclusion, especially when it means that they can avoid paying you hundreds of thousands of dollars or more.
There are two potential ways to appeal the denial of a long-term disability claim:
- If your policy was provided through your employer, it is an employee benefit, and it may be subject to ERISA. There is a special appeals process under ERISA, where you have to go through the insurance company first. If and when they deny your appeal, you would need to go to a federal district court.
- If you purchased the disability insurance policy on your own, you can file a lawsuit against New York Life in state court. The policy that you have purchased is a binding contract, and you can sue the insurance company for breach of contract. If a judge or jury finds that you are disabled, within the meaning of the policy, they would order New York Life to pay you benefits.
Bad Faith Lawsuits Against New York Life
If you are suing New York Life in state court, you may have an additional cause of action against the insurance company. If New York Life has broken the law in delaying their response to your claim, or unreasonably denying your benefits, you could consider filing a bad faith lawsuit against them.
A bad faith insurance lawsuit is a direct claim against the insurance company for the damages that they have caused you by breaking the law. You may even be able to qualify for punitive damages if you can prove that the insurance company’s actions were egregious and intentional.
In one case, a policyholder sued New York Life for bad faith because he alleged that they determined in advance that they would deny his claim and they “undertook a conscious campaign calculated to delay and avoid payment on his claims.”
In general, the fact that the insurance company denied the claim is not alone evidence of bad faith. You must show that the insurance company knew that there was not a reasonable basis to deny your claim, and they did it anyway. There is a high bar that you need to meet, but you may be entitled to substantial financial compensation if you win.
What to Do if Your Long-Term Disability Claim Is Denied
Regardless of what law controls your plan, you would need to address the reason why the insurance company denied your claim. They would need to provide you with a reason why they denied your claim in the first place. If they say that your claim was missing certain information that would prove you are disabled, you may need to go back to the doctor to augment your medical records.
Then, you may hire an attorney to learn your options for fighting back. You may have a limited amount of time to act, depending on which forum you need to go to for relief. Further, you need these benefits to keep paying your bills. Your attorney could build a record that could be the basis of your appeal or lawsuit.
